The Council will permit the successful Delivery Partner to make the Framework accessible to other definable recognisable classes of Contracting Authority which are eligible, and grant a concession to the Delivery Partner to design, procure, and subsequently manage the Framework in return for a concession fee (whether in the form of rebates or otherwise) to be established under this procurement process. The Delivery Partner will be required to make all necessary commitments and investments, resources, financial or otherwise, to work in partnership with the Council to establish the Framework and will not receive any consideration or payment from the Council for the whole of the services to be delivered under the awarded Contract. In consideration for the Council awarding a Concession Contract to the Delivery Partner to design, procure, and subsequently manage the Framework, a concession fee will be payable by the Concessionaire to the Council. The concession fee is in return for the Delivery Partner commercially managing and deriving a commercial income from the Framework. The Delivery Partner shall accept that the Council cannot and does not guarantee to establish the Framework and does not give any warranty, express or implied about procurement rules, vires or volume.
